When you visit our Site, we may automatically collect:

For prospect data, you (the user) act as the data controller and MentionAgent acts as the data processor. We process prospect personal data solely on your behalf and according to your instructions through the Service.

2. How We Use Your Information

We use the information we collect to:

• Provide, maintain, and improve the Service.
• Process your subscription payments through Stripe.
• Find relevant outreach prospects and draft personalized emails on your behalf.
• Send and receive outreach emails via third-party email providers (currently Resend).
• Communicate with you about your account, service updates, and support requests.
• Detect, prevent, and address fraud, abuse, or technical issues.
• Comply with legal obligations.

3. Legal Basis for Processing (GDPR)

If you are located in the European Economic Area (EEA) or United Kingdom, we process your personal data based on the following legal grounds:

• Contract performance: Processing your account information, business profile, and outreach data is necessary to provide the Service you subscribed to.
• Legitimate interest: We process analytics data to improve our Site and Service, and we process prospect data (publicly available names and email addresses) to deliver the core functionality of the Service on your behalf.

We do not sell your personal information. We may share your data with the following parties:

• AI providers: We use Anthropic's Claude API to generate personalized outreach emails. Prospect information and your business profile are sent to this provider for processing. See Anthropic's Privacy Policy.
• Telegram: We deliver email drafts and notifications to you through Telegram's Bot API. See Telegram's Privacy Policy.
• Legal requirements: We may disclose information if required by law, regulation, legal process, or government request.

5. Data Retention

We retain your account information and service data for as long as your account is active or as needed to provide the Service. If you cancel your subscription, we will delete or anonymize your data within 90 days, unless we are required to retain it for legal or legitimate business purposes.

Outreach campaign data (prospect information, email threads, and conversation history) is retained for the duration of your subscription and deleted within 90 days of account closure.

6. Data Security

We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include encryption of data in transit, access controls, and secure storage practices.

However, no method of transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

Our third-party service providers (Stripe, Resend, Anthropic, Telegram) may process data in various jurisdictions. We ensure appropriate safeguards are in place for such transfers in accordance with applicable data protection laws.

The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If you believe we have inadvertently collected such information, please contact us and we will promptly delete it.

11. Cookies and Analytics

Our Site does not use cookies. We use Datafast, a privacy-friendly analytics service, to collect anonymous usage data such as page views, referrer URLs, and browser type. This data is aggregated and cannot be used to identify individual visitors. No personal data is collected through our analytics.
